By execution hereof, I understand, acknowledge and agree that my voluntary participation in any exercise training session or sports training camp, whether in an individual, group, or camp setting (the “Event”), sponsored by The Fortis Academy, LLC, Terry Lynner, Pro-T, LLC, High Goals, LLC and Champions Hall or any of its affiliates or subsidiaries involves strenuous physical activity and potential risk of injury.  I understand and acknowledge that The Fortis Academy, LLC, Terry Lynner, Pro-T, LLC, High Goals, LLC and Champions Hall employees, agents or contractors are not trained physicians, and I have or had the opportunity to consult with my physician prior to engaging in the Event. As such, I hereby agree to accept any and all risk of injury, including, without limitation, death, in connection with my participation in any such event.

In consideration of my participation in any such Event, I further agree that neither I nor my spouse, partner, assignees, heirs, guardians, successors or legal representatives, or anyone claiming through me or any of them, directly or indirectly (collectively, “Representatives”), shall make a claim against, sue, and/or attach the property of The Fortis Academy, LLC, Terry Lynner, Pro-T, LLC, High Goals, LLC and Champions Hall for any sort of injury or death I may suffer in connection with my participation in any such Event.  Further, on behalf of myself and my Representatives, I hereby agree to hold harmless and release The Fortis Academy LLC,  Terry Lynner, Pro-T, LLC, High Goals, LLC and Champions Hall from liability and waive any and all claims whatsoever against The Fortis Academy, LLC, Terry Lynner, Pro-T, LLC, High Goals, LLC and Champions Hall for any injury or death that I may suffer during the course of, or proximately caused by, my participation in any such Event, whether due to the negligence, or any other act, however caused, of any The Fortis Academy, LLC, Terry Lynner, Pro-T, LLC, High Goals, LLC and Champions Hall, its employees, agents or contractors.

Consent to Use Photos and Videos for Promotional Purposes

I have carefully read this Exercise and Sports Training Waiver and Release Agreement, fully understand its contents, and understand that it is a legally enforceable and binding contract. I hereby release the use of photos and videos taken during the Events to be used for promotional purposes only for The Fortis Academy, LLC, Terry Lynner, Pro-T, LLC, High Goals, LLC and Champions Hall.

Cancellation Policy

All cancellations will be subject to a 10% or $50 cancellation fee, whichever is greater. If a cancellation occurs within 6 weeks of camp starting, the cancellation fee is 50% of the total cost of camp. If a cancellation occurs within 2 weeks of camp starting, there are no refunds. Subject to approval by Fortis, customers are allowed to find someone to take their place in camp to avoid the cancel fees. Fortis reserves the right to provide free of charge cancellations for families in the event of injury, illness, or other extenuating circumstances. 

PARENTAL AGREEMENT FOR PARTICIPANTS OF MINORITY AGE (UNDER AGE 18 AT THE TIME OF REGISTRATION)

This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all the Releasees, and for myself, my heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releasees from any and all liabilities incident to my minor child’s involvement or participation in these programs as provided above, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent permitted by law.
