Monthly Gym Membership Agreement
This Gym Membership Agreement (“Agreement”) is made between Fortis Fitness ("Gym") and
signed member listed below ("Member").

• Gym Address: 7000 Washington Ave S, Eden Prairie, MN 55344
1. Membership Term
This Agreement begins on the date of signature and renews on a monthly basis unless terminated
by either party in accordance with this Agreement.
2. Monthly Fees and Payment
• The Member agrees to pay the monthly membership fee each month.
• Fees will be automatically billed to the Member’s credit/debit card or bank account on file.
• Payments are non-refundable, except as outlined in this Agreement.
3. Cancellation Policy
• To cancel this membership, the Member must provide a written notice 30 days in advance.
• Cancellation requests can be submitted via email, mail, or in person at the gym’s front desk.
• The Member remains responsible for any fees incurred during the 30-day notice period.
4. Freezing/Pausing Membership
• The Member may freeze or pause the membership for up to 3 months once per year due to
medical or personal reasons.
• To freeze a membership, a written request must be submitted with relevant documentation
5. Gym Facilities and Rules
• The Member agrees to abide by all Gym policies, including facility hours, safety protocols,
and conduct guidelines.
• Gym facilities are subject to availability and may close for repairs, holidays, or other reasons.
6. Assumption of Risk and Limits of Liability
• The Member acknowledges that engaging in physical activities at the Gym involves inherent
risks, including but not limited to injury, illness, or accidents.
• The Gym is not liable for any injury, illness, or other harm that may arise from the Member’s
use of facilities or participation in activities, whether supervised or unsupervised.
• The Gym is not responsible for personal belongings lost, stolen, or damaged on Gym
premises.
7. Waiver of Liability
• The Member, on behalf of themselves and any heirs or legal representatives, hereby waives,
releases, and discharges the Gym, its employees, agents, and affiliates from any liability for
personal injury, death, or damage to personal property, arising from participation in any Gym
activity.
• This waiver does not apply to gross negligence or intentional misconduct by the Gym or its
staff.
8. Indemnification
The Member agrees to indemnify and hold the Gym harmless from any claims, liabilities, or
expenses (including attorney fees) arising out of the Member’s conduct or participation in Gym
activities, including any damages caused to Gym facilities or equipment.
9. Medical Authorization and Release
• The Member authorizes the Gym to obtain or provide emergency medical care in case of
accident or injury.
• Any costs incurred for such treatment are the Member’s sole responsibility.
10. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes any prior
agreements, understandings, or arrangements. No amendment or waiver shall be effective unless
signed by both parties.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of
Minnesota.
12. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions
shall remain in full force and effect.
