The Range: Hockey Skills Area Rental Contract


This “The Range: Hockey Skills Area” Rental Contract is made and entered into the date indicated below. High Goals, LLC, doing business as Champions Hall, herein after referred to as CH and on behalf of  herein after referred to as (USER). CH and USER, agree to the following:

I.            CONTRACT INCLUDES

  1. CH “The Range: Hockey Skills Area” Facility Confirmation – Addendum A.
  2. CH User Rules – Addendum B

II.           RENTAL TERMS

  1. Rental Fees are as follows:
    1. All rental fees for “The Range: Hockey Skills Area” shall be paid prior to the start of any rental. Rental fees can be paid and reservations can be made at www.thefortisacademy.com/the-range.
  1. Assignments:
    1. CH does not grant USER permission to use the Facility at any other time or for any other purpose other than the hours reserved online at thefortisacademy.com/the-range. This Contract does not create the relationship of landlord and tenant, as contemplated by the laws of Minnesota, between CH and USER. During the use period, CH does not relinquish its right to control the management of its facility and its equipment and to enforce all necessary laws, rules and regulations. Any matters not expressly provided for in this Contract shall be resolved by CH at its sole discretion.
    2. CH may eject or cause the ejection of any person or persons who violate laws, Champions Hall User Rules or regulations, or otherwise behave in a disorderly manner. USER waives all rights and all claims for damages against CH, its members, employees or agents arising out of, resulting from, or in any way connected with the exercise of such authority by CH.
    3. CH must approve your rental use.
    4. USER will circulate to each participant in its association or group, a copy of the CH User Rules prior to use of CH.
    5. CH will give USER 30 days’ notice and duration to vacate the space if “The Range: Hockey Skills Area” is leased
  1. IV. FIRST AID

CH will not provide any first aid services. USER agrees to contract independently for any first aid services needed. Any medical expenses, including ambulance fees, or other costs incurred by CH for the intended benefit of USER or its members shall be reimbursed by USER to CH.

III.         CONCESSIONS 

USER and all members of its association or group are prohibited from bringing food or beverages onto the premises of CH. Only bottled water or water in drinking bottles may be brought onto the CH “The Range: Hockey Skills Area”. Violators of this provision will be asked to leave CH and the User agrees to pay a $100 clean up fee if demanded by CH.

V.           SPONSORSHIP AND ADVERTISING

USER must have prior written approval from CH before posting any temporary materials in the “The Range: Hockey Skills Area”.

VII.        COMPLIANCE WITH LAW

During the use period, USER shall comply with all laws, ordinances, rules, and regulations of CH, federal, state, and local government entities having jurisdiction over the facility.

VIII.      DAMAGE TO PROPERTY

USER assumes full responsibility for the acts and conduct of all USER personnel and members of its association or group while at CH. USER will pay CH upon demand for any damage to the facility which is reasonably believed by CH to have been caused by USER’S personnel or members of its association or group.  Such payment shall be an amount CH deems reasonably necessary to restore the premises to its former condition. Replacement of equipment shall be on a like-kind and quality basis.

  1. INDEMNIFICATION AND INSURANCE

In consideration for being allowed to use CH’s “The Range: Hockey Skills Area”, USER agrees to indemnify and hold harmless CH and its owners and affiliates from and against all claims of whatever nature arising from (i) any act, omission or negligence of USER, or USER’s personnel, members, licensees, agents, employees, or related parties, or (ii) arising from any accident, injury, including death, or damage to any person or property occurring on CH premises, or (iii) from any act, omission or default under any of USER’s undertakings or obligations under this “The Range: Hockey Skills Area” Rental Contact. This indemnity and hold harmless agreement shall include indemnity against all costs, expenses (including attorney fees) and liabilities from or in connection with any such claim or proceeding brought thereon and the defense thereof. USER shall at its expense, obtain liability insurance against claims for bodily injury, death and property damage occurring on or about CH’s “The Range: Hockey Skills Area” premises, such insurance to be on the so-called “occurrence” form with a combined single limit of not less than $1,000,000.00. Evidence of such policy shall be provided to CH prior to and as a condition of USER’s use of CH’s “The Range: Hockey Skills Area”. Failure to provide such policy will not release USER from its obligation to pay for amounts due hereunder. USER shall also maintain all workers compensation insurance required by law.

  1. TERMINATION

If CH, in its sole discretion, is unable to allow USER to use the facility at any time during the use period due to destruction of or damage to the facility, or because of natural condition, civil commotion or emergency, this Contract is terminated without liability to either CH or USER. CH will make a reasonable effort to reschedule the field rental if CH “The Range: Hockey Skills Area” is not available at agreed upon time(s). In addition to any other remedy available to CH under this agreement or under existing law, if USER fails to perform or comply with any of the terms and conditions of this agreement, CH may terminate this Contract without any liability or further obligation to USER by giving USER written notice of such termination.

ENTIRE AGREEMENT

THIS CONTRACT CONSTITUTES THE ENTIRE AGREEMENT BETWEEN CH AND USER AND SHALL SUPERCEDE ALL PRIOR WRITTEN, VERBAL, AND/OR IMPLIED CONTRACTS AND AGREEMENTS. THE UNDERSIGNED AGREES TO PURCHASE ALL HOURS OUTLINED HEREIN.  NO PROVISION OF THIS AGREEMENT MAY BE CHANGED, WAIVED, OR TERMINATED UNLESS DONE IN WRITING AND EXECUTED BY BOTH CH AND USER.  IT IS UNDERSTOOD THAT CH RESERVES THE RIGHT TO CANCEL THIS CONTRACT FOR ANY DEFAULT BY THE UNDERSIGNED, AS PER THE TERMS OF THIS AGREEMENT.

Addendum B - The Range: Hockey Skills Area & Champions Hall Rules of Conduct

Rules for The Range: Hockey Skills Area

  1. Players must wear helmets while in the shooting area
  2. If the number of players is such that social distancing is not possible, all players must wear masks throughout the training session
  3. Any damage to the facility must be reported immediately to The Fortis Academy and Champions Hall
  4. Each rental is 55 minutes. Please leave promptly at the end of your rental so the next group can start on time.

Rules for Champions Hall

  1. CH has the right to remove, suspend or ban any player, parent, coach, umpire or spectator from playing, entering or remaining at the facility if the person is deemed to have violated these CH Rules of Conduct. This decision is at the sole discretion of the on-site manager. Appeals must be submitted in writing or via email
  2. No fighting, violence or excessively rough play is permitted, and will result in immediate removal. Inappropriate language or abusive comments toward anyone is grounds for removal
  3. Proper attire is expected of all participants and spectators. All participants must wear the customary sport-specific attire and safety equipment. Footwear must be reasonable for artificial turf, no metal spikes allowed. No dirty or muddy shoes will be permitted. If any player is caught with dirty or muddy shoes they will be asked to leave immediately and will not be allowed back in CH that day
  4. All spectators enter the facility at their own risk, the facility is designed for participants, not spectators, and extreme care must be taken by spectators to avoid accidental injury from balls, players, etc
  5. Any player or group entering the field area prior to their designated rental time must stay outside the outermost boundary lines and not interfere with the current users. The field may only be entered and exited through the designated doors on the west end of the field
  6. All youth team participants must have a designated responsible parent or coach (over age 18) with them at all times. Participants must not enter the field or hardwood courts until this person is supervising their activity
  7. Upon expiration of your rental period, you and your team must quickly conclude your organized activities, gather your equipment and exit the field. You must be completely off the field when your time expires. If you interrupt the usage of another customer, you or your team/group may be charged a portion of their rental fee
  8. No littering INCLUDING GUM, SUNFLOWER SEEDS AND PEANUT SHELLS. Teams/user groups may be assessed a clean-up fee of $100.00 or suspended if littering is observed by the on-site manager
  9. No outside food or beverages are allowed at CH. Only bottled water and sealable water bottles are allowed on the “The Range: Hockey Skills Area”. All other drinks including soda pop and energy drinks are prohibited. No food is allowed on the field.  NO SPITTING.  No tobacco or alcohol products of any nature are allowed on the field. Violators will be asked to leave CH and the user group may be assessed $100
  10. Each team/user group must provide their own First Aid kit
  11. CH is not responsible for any lost or stolen item(s). CH does maintain a lost and found, so please ask if you are missing an item
  12. Referees and umpires are to be treated respectfully. Each referee/umpire has complete authority and his/her decisions in a game are final. Referees/umpires are independent subcontractors and are not employees of CH
  13. Respect the facility. Failure to use the field or any equipment properly will result in removal
  14. Use of microphones, amplifiers or any other artificial sound devices, except coach’s whistles is prohibited
  15. USERS MAY NOT MOVE THE SOCCER OR LACROSSE GOALS PROVIDED BY CH. The equipment must be moved only by CH Staff or under supervision by CH staff. Play should not commence until all goals have been properly secured. If placement of the goals other than as provided is desired, request CH Staff to move the goals. All other CH equipment, cones, etc., must be picked up and appropriately returned to the proper storage location by the users before the end of their rental period. The mid-field curtain may only be raised or lowered by CH staff
